This website is operated by BWJ Designs. Throughout these Terms of Service, the terms “we”, “us”, and “our” refer to BWJ Designs. BWJ Designs offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our website and/or obtaining any products or services from us, you engage in our “Service” and agree to be bound by the following terms and conditions. These Terms of Service apply to all users of the site including browsers, customers, and contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. Any new features or tools added to the current website shall also be subject to the Terms of Service. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
1. Acceptance of Terms
By accessing and using the BWJ Designs website (https://www.bwjdesigns.com) or placing an order, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
2. Services & Product Definitions
BWJ Designs offers custom and personalized products including but not limited to stationery, drinkware, apparel, accessories, household items, gift sets, jewelry, and digital products.
Digital Products: Downloadable files, templates, designs, or other digital content delivered electronically.
Custom Products: Personalized or made-to-order physical items created specifically for your order based on your specifications.
Made to Order Products: Items produced upon order placement that are not personalized but are created on demand.
Standard/Pre-Made Products: Pre-made items and non-customized merchandise available from existing inventory.
Collection Items: Curated product sets and bundles offered as a complete collection.
3. User Eligibility
You must be at least 16 years old to use our services. By using our website, you represent and warrant that you meet this eligibility requirement. The Site is not intended for individuals under the age of 16. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at support@bwjdesigns.com to request deletion.
4. Ordering and Payment
All orders are subject to acceptance and availability. Prices are subject to change without notice.
Online Payment Methods: Visa, Mastercard, American Express, Discover, Apple Pay, Google Pay, Afterpay, and Klarna.
In Person Payment Methods: Cash and Square.
BWJ Designs ships to USA addresses only. Payment is required at the time of order placement for standard and digital products. Custom and made to order items are subject to the payment terms outlined in Section 6.
5. Sales & Return Policy
Digital Products, Custom Products, Made to Order, and Collection Items: All digital products, custom physical products, made to order items, and collection items are FINAL SALE and NON-REFUNDABLE. Due to the personalized and on-demand nature of these items, we cannot accept returns, exchanges, or provide refunds once an order is placed.
Pre-Made/Standard Products: Pre-made items may be eligible for return or exchange. Returns or exchanges must be requested within 3 days of delivery. Only unopened and unused products are eligible for return or exchange. Customers are responsible for return shipping costs. Authorized refunds are subject to a 40% restocking, processing, and handling fee. Refunds are processed within 5 business days after receipt and inspection and are issued to the original form of payment. Bank processing may take up to 14 business days to reflect the refund. All returns require prior written authorization from BWJ Designs.
6. Custom Orders & Payment Policy
Online Orders: All custom, made to order, and collection orders placed through the BWJ Designs website are paid in full at the time of checkout unless otherwise noted on the product listing.
In Person Custom Orders: In person custom orders require a non-refundable retainer of 50% of the order total to reserve your order. The remaining balance is due upon completion and before delivery. Orders will not be released or shipped until the balance is paid in full.
Price Quotes: Prices quoted for custom orders are valid for 5 days from the date of quotation unless otherwise specified. Once an order is placed and confirmed, the price is locked in for that specific order.
Non-Payment of Balance: If the remaining balance on an in person order is not paid within 48 hours of notification that your order is ready, the order will be canceled and the retainer will be forfeited. BWJ Designs reserves the right to resell the item.
BWJ Designs reserves the right to refuse any custom order at our discretion.
7. Cancellation Policy
Orders may be canceled within 24 hours of initial placement by contacting BWJ Designs. Cancellations will not be accepted after 24 hours.
Once production has begun on any custom, made to order, or collection item, cancellations cannot be processed under any circumstance. All retainers and deposits paid are non-refundable, even if canceled within the 24-hour window. For pre-made products that have not yet shipped, a cancellation fee of 25% of the order total will apply if canceled after 24 hours.
8. Shipping & Processing
Processing and shipping times vary by product. Please refer to the individual product listing for estimated processing and delivery timeframes. Rush processing is available on select items and is subject to an additional fee as noted in the product listing.
Standard processing is up to 10 business days. Blankets and collection orders require up to 20 business days. Specific timeframes are noted in each product listing. Business days exclude weekends and holidays.
During peak seasons, pandemics, severe weather, or carrier delays, delivery may take up to 30 business days.
A tracking link will be provided in your order confirmation email. For orders processed by production partners, tracking updates may be delayed by 2 to 5 days.
BWJ Designs ships to USA addresses only. Free shipping is available on select items as noted in the individual product listing. International shipping is not available at this time.
9. Delivery Issues
Package Not Received: Check the tracking information provided. If marked as delivered but not received, contact the carrier directly. BWJ Designs is not responsible for lost, stolen, or misdirected packages but will assist in tracking your package to the best of our ability.
Refused or Returned to Sender: Orders refused or returned to sender will be processed as a return. Re-shipping is available at the customer’s expense. Custom, made to order, and collection products are not eligible for refund if returned or refused.
10. Damaged or Defective Items
All items are shipped with insurance coverage. If your item arrives damaged or defective, contact us immediately upon delivery and provide clear photographs showing the damage along with your order number and description of the issue. We will file an insurance claim and arrange for replacement as appropriate.
To request authorization for a replacement or refund on eligible standard products, customers must contact us within 3 days of delivery with clear photographs and their order number. If there is a manufacturing error on a custom product, contact us within 48 hours of delivery for a replacement of the exact same item. Requests submitted after these timeframes or without photographic evidence will not be considered.
11. Customer Typographical Errors
BWJ Designs is not responsible for typographical errors submitted by the customer. All custom orders are produced exactly as the information is received. We input what we are given. Customers are responsible for carefully proofreading all submitted text, names, dates, and details before placing their order. BWJ Designs cannot be held liable for errors in customer-submitted information.
12. Incorrect Shipping Address
BWJ Designs is not responsible for orders shipped to an incorrect address provided by the customer. Please verify your shipping address carefully before completing your order. Additional shipping fees may apply to reship to a corrected address. BWJ Designs is not liable for lost or undelivered packages resulting from an incorrect address submitted at checkout.
13. Image Quality Requirements
All images submitted for custom orders must be a minimum of 300 DPI to ensure optimal print quality. BWJ Designs is not responsible for poor print or product quality resulting from low resolution or poor quality images submitted by the customer. All images are reviewed prior to production. If a submitted image does not meet the required 300 DPI standard, the customer will be notified before processing begins. It is the customer’s responsibility to provide images that meet this requirement. BWJ Designs reserves the right to decline any order where image quality cannot be corrected.
14. Color Disclaimer
Colors displayed on your screen may vary from the actual product color. Monitor settings, screen resolution, and display calibration can affect how colors appear digitally versus in person. BWJ Designs is not responsible for color variations between what is seen on screen and the final product.
15. Handmade & Product Variation Disclaimer
Some BWJ Designs products are handmade. As a result, slight variations in color, texture, and finish may occur and are considered part of the unique character of handmade goods. These variations are not defects and are not grounds for a return or exchange. Machine produced items maintain greater consistency; however, handmade items will reflect the nature of artisan craftsmanship. All products come with specific use and care instructions. It is the customer’s responsibility to read, understand, and follow these instructions. Failure to follow the provided instructions may void any applicable guarantees and relieve BWJ Designs of liability for damage or deterioration.
16. Digital Product Usage Rights
Digital products purchased from BWJ Designs are licensed for personal use only.
You may: Use digital products for personal projects. Share digital products with others only with explicit written permission from BWJ Designs.
You may NOT: Resell, redistribute, or commercially exploit digital products. Claim digital products as your own work. Use digital products for commercial purposes without explicit written permission. Reproduce or distribute our designs beyond the license granted.
17. Intellectual Property
All designs, including custom designs created for clients, remain the intellectual property of BWJ Designs. Customers are not granted any rights to use, reproduce, or distribute our designs beyond the physical product purchased or the limited license granted for digital products. Unauthorized use, reproduction, or distribution of our designs is strictly prohibited.
As a print on demand company, we use images purchased from third-party providers in some of our designs. We have obtained the necessary licenses to use these images in our products. However, the copyright for these images remains with the original creators or license holders. Customers may not extract or separately use any third-party images from our products for any purpose outside of the intended use of the product they have purchased. We cannot transfer or extend our image licenses to customers for uses beyond the products we offer.
18. User Content & Custom Order Materials
If you provide any content for custom orders, you retain ownership of your proprietary logos or trademarks. You grant BWJ Designs a non-exclusive, royalty-free license to use, reproduce, and display this content for the purpose of fulfilling your order and for promotional purposes unless otherwise agreed in writing. You represent and warrant that you have the right to provide such content and grant this license.
19. Third-Party Links, Images, and Affiliations
Certain content, products, and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. Some links may be affiliate links, which means we may earn a commission if you purchase through these links. We will clearly identify affiliate links when they are used. We are not responsible for examining or evaluating the content or accuracy of third-party sites, and we will not have any liability or responsibility for any third-party materials or websites.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. We are under no obligation to maintain any comments in confidence, pay compensation for any comments, or respond to any comments.

You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. 22. Accuracy of Billing and Account Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.
In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. You agree to provide current, complete, and accurate purchase and account information for all purchases made through our website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
23. Errors, Inaccuracies, and Omissions
Occasionally there may be information on our website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the website is inaccurate at any time without prior notice, including after you have submitted your order.
We undertake no obligation to update, amend, or clarify information on the website, including without limitation pricing information, except as required by law.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service or any part thereof without notice at any time. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.

To the fullest extent permitted by law, BWJ Designs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. In no case shall BWJ Designs, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort including negligence, strict liability, or otherwise, arising from your use of any of the Service or any products procured using the Service.
BWJ Designs is not liable for any dissatisfaction with the final product provided it matches the agreed-upon design and specifications within reasonable expectations for handmade items, for damage resulting from product misuse, or for damage resulting from failure to follow care instructions. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
28. Indemnification
You agree to indemnify, defend, and hold harmless BWJ Designs and our directors, officers, employees, affiliates, agents, contractors, licensors, service providers, subcontractors, and suppliers from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service, your violation of any law, or your violation of the rights of a third party.
29. Force Majeure
BWJ Designs shall not be expected or required to perform any of the services under these Terms of Service or be liable in damages for any delay or default in performing hereunder if such delay or default is caused by conditions beyond our control, including but not limited to acts of God, government restrictions, wars, insurrections, pandemics, severe weather, work stoppages, carrier delays, and/or any other cause beyond our reasonable control, including mechanical, electronic, or communications failures.
30. Termination
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our website.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
Any orders that are already in production at the time of termination will be completed and delivered unless otherwise agreed upon. BWJ Designs reserves the right to modify or discontinue, temporarily or permanently, the Service or any part thereof with or without notice.
31. Severability
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us including any prior versions of the Terms of Service.
